Spain fined 15 million for poor privacy protection

The Court of Justice of the European Union has just imposed a fine on Spain for failing to protect users’ private data during police investigations.

The European Court of Justice on Thursday sanctioned Spain for not having transposed a European directive dating from 2016. This text aims to protect the personal data of citizens during a police investigation. Madrid will have to pay a fine of 15 million euros, to which are added a € 89,000 penalty per day “until the observed breach has been brought to an end», Wrote the Court of Justice of the European Union (CJEU) in a press release.

Madrid had already been called to order twice by the European Commission: a formal notice in July 2018, which had no effect, and a reasoned opinion in January 2019. In their response, the Spanish authorities had justified their delay by the interim character, during the period concerned, of the government, which did not have a parliamentary majority at the time and only managed current affairs pending the formation of a new government.

Spain’s justice ministry has not commented on the conviction.
